Permanent Parenting Plan - Your proposed arrangements for how you and your spouse will take care of your child after your divorce. Choose one of these Gwinnett County parenting plan forms:

Gwinnett County Child Custody Forms
If you are initiating a divorce action with children involved, the main Divorce Complaint form should specify the type of child custody you are seeking (see above). Other Gwinnett County forms for child custody cases include:
- Declaration of Sole Custody - To be filed if your spouse is not the legal father of your child and has not requested the court to legitimate the child as their own.
- Petition for Modification of Child Custody and/or Support - The main document to request the court to change your existing child custody order. This should be filed alongside your new Parenting Plan proposal.
- Consent to Modification of Custody - If your ex-spouse is the one requesting child custody modification, and you agree to their new plan, you may file this form.
- Contempt Petition - If there is an existing child custody or visitation order, and your ex-spouse has violated it, you may request the court to cite them for contempt.
- Petition for Legitimation and/or Custody/Visitation - If a child is born out of wedlock, the father may need to go through the legitimation process before he can be recognized as a legal parent. This form is to request legitimation and parental rights.
- Acknowledgment of Service and Consent to Legitimation - This is the official agreement of the legal parent to the legitimation request of the other parent.
Gwinnett County Child Support Forms
If filing the Divorce Complaint form, you can specify whether or not you are seeking child support, and attach your Child Support Worksheet to show the calculation (see Divorce section above). Other Gwinnett County forms for child support include:
- Separate Maintenance Complaint with Children - File this if you are not divorcing your spouse but are only living apart and seeking child support.
- Petition for Modification of Child Custody and/or Support - The main document to request the court to change your existing child support order.
- Contempt Petition - If there is an existing child support order and your ex-spouse has violated it, you may request the court to cite them for contempt.
- Petition for Enforcement of Support Order - If your ex-spouse has stopped paying child support, you may ask the court to take further legal steps to ensure that payments reach you. Examples of these are wage garnishment or withholding the payor’s tax refunds.
